Early Cases: 1986-1999
The insidious disease known as mesothelioma first reached the California Supreme Court in 1986 in the case of General Foundry Service versus Workers’ Compensation Appeals Board. (General Foundry Serv. v. Worker’s Comp Appeals Bd., 42 Cal.3d 331 (1986)). In this early case, a molder for a foundry was exposed to asbestos and silica dust for 29 years while on the job. The California’s Supreme Court defined mesothelioma as “a disease of the mesothelioma surface lining (i.e. chest and stomach lining). . [that is] a diffuse malignancy which spreads across the serous surfaces.” (General Foundry Serv. at pg 335).
The primary legal issue before the high court was whether the Workers’ Compensation Board applied the correct determination for temporary status when a worker has a progressive disease such as mesothelioma. The court held that the board could tentatively rate the permanent disability of the injured worker with a progressive disease, and it could order advances based on that tentative rating. The court also stated the Board may reserve jurisdiction on a final determination of permanent disability, waiting to learn if the employee’s condition becomes permanent and stationary, or when the employee’s permanent disability is total and further deterioration by the progressive disease would be irrelevant. (General Foundry Serv.)
It wasn’t until eleven years later that another case regarding mesothelioma would reach California’s High Court. In this case a gentlemen sued Owens-Corning Fiberglas Corporation for his exposure to asbestos some 30 years prior. (Buttram v. Owens-Corning Fiberglas Corp., 16 Cal.4th 520 (1997)).
In 1986, California had passed a law that changed the popular law rule of joint and several liability by limiting the defendant tortfeasor’s damages to only the direct percentage section that can be attributed to the defendant. (Buttram at pg 524). This means if a defendant is found to be only 42% at fault, they only have to pay 42% of the noneconomic damages, such as pain and suffering.
What made this case unique is that the trial court ruled on testimony that the plaintiff probably already had cancerous cells formed before this law went into effect. Therefore, the new law did not apply because the disease had “accrued” before the passage of the new law. (Buttram).
The Supreme Court of California held that for the purposes of determining accrual of a latent and progressive asbestos-related disease such as mesothelioma, it accrues when the plaintiff is either diagnosed with the disease for which damages are being sought or otherwise discovered the illness or injury. (Buttram at pg 525).
In that same year, the California Supreme Court heard another case involving an asbestos-related mesothelioma plaintiff. (Rutherford v. Owens-Illinois, Inc., 16 Cal.4th 953 (1997)). At issue there was whether a trial court’s instruction to the jury regarding defendant’s burden of proof in a mesothelioma lawsuit was so prejudicial as to reverse the lower court and remand the case wait on to the trial court for further proceedings. (Rutherford).
The Supreme Court concluded that the burden-shifting jury instruction was an error on the fragment of the trial court. However, it held that for cases of asbestos-related cancers such as mesothelioma, proof of the cause in such cases will always bring practical difficulties because of the long latency period and the occupational settings that a worker is exposed to with multiple forms or brands of asbestos products and varying degrees of toxicity. (Rutherford at pg 957).
Instead, a mesothelioma plaintiff can demonstrate that exposure to the defendant’s asbestos product was “in reasonable medical probability” a substantial cause or contributed to the plaintiff’s risk of getting the disease. (Rutherford at pages 957-958).
In the last case before the turn of the century and new millennium, Chevron U.S.A. Inc. brought an appeal all the way to California’s Supreme Court. (Chevron U.S.A., Inc., v. Workers’ Compensation Appeals Board, 19 Cal.4th 1182 (1999)). This was another Workers’ Compensation-related case where an individual died from mesothelioma that was diagnosed after his retirement. Although the plaintiff was originally diagnosed with parenchymal asbestosis due to asbestos inhalation, the plaintiff was diagnosed 10 years later, after his retirement, with peritoneal mesothelioma, which is an asbestos-related cancer of the lining of the abdominal cavity. (Chevron at pages 1186-1187).
At the heart of this long and complex mesothelioma litigation was how much death benefit the surviving spouse should receive based on the amount of support loss after the death of the plaintiff. On one of Chevron’s many appeals, the Court of Appeal interpreted a statute that put a limitation on the type of support that could be considered for the purposes of establishing the death attend. (Chevron).
The statutory scheme allows for a death benefit of four times the amount of earnings devoted to the support of the decedent’s dependents, and the statute puts a cap on the amount of the defendant’s liability based on the year the case is decided. (Chevron at page 1192). The Court of Appeal ruled that the back must be based on the amount of support actually lost or affect by the plaintiff’s death, and it could not include income and investments that did not end or change as a result of the death. (Chevron).
California’s Supreme Court reversed the lower court and held that the statutory language does not preclude the exhaust of other earnings after retirement. It explained that the Court of Appeal’s decision was wrong, and “such an interpretation is extremely harsh, especially in cases of death from employment-related injuries, like mesothelioma, that occur after retirement, when the employee is no longer receiving any earnings from employment.” (Chevron at pg 1198). Therefore, the death benefit under Workers’ Compensation cases can be based on income other than earnings from the employer, after retirement and subsequent death from a latent disease such as mesothelioma.
Cases from 2000 to 2007
In the new millennium it didn’t take long for a mesothelioma case to reach the Supreme Court in California. (Hamilton v. Asbestos Corporation, LTD., 22 Cal.4th 1127 (2000). At issue in this case is when the statute of limitation in latent diseases such as mesothelioma. (Hamilton at pg 1132).
In California there is a special statute of limitations law for injuries or diseases caused by exposure to asbestos. The lower court held the mesothelioma lawsuit was not grand because it was beyond the statute of limitations – the plaintiff had filed a lawsuit for a different disease arising from the same asbestos exposure. (Hamilton).
What makes this statute relevant is the long latency period of up to thirty to forty years before the cancerous mesothelioma is diagnosed. In this case, the plaintiff discovered a different asbestos-related disease, asbestosis, and filed a lawsuit. Two years later, the plaintiff was diagnosed with malignant peritoneal mesothelioma, and the court consolidated the lawsuits. The medical testimony established that the asbestosis found in 1979 and the malignant mesothelioma found in 1996 were two separate and distinct disease. (Hamilton at pgs 1135-1136).
Because the malignant mesothelioma was a separate and distinct disease not discovered until 1996, the Supreme Court reversed the lower court, holding that it was not “discovered” for the purposes of the statute of limitations until 1996. (Hamilton at pgs 1146-1147).
In 2005, the Supreme Court once again heard a case involving asbestos-related mesothelioma; however, instead of an employee contracting this insidious disease, it was an independent contractor’s employee. (Kinsman v. Unocal Corporation, 37 Cal.4th 659 (2005). In this case, a carpenter was an independent contractor hired to work for defendant’s premises where he was exposed to asbestos. Years later the carpenter was diagnosed with mesothelioma. At issue was when is a defendant landowner liable to an independent contractor’s employee who is injured as a result of hazardous conditions on the defendant’s property. (Kinsman at pg 664).
Here, the High Court held that a landowner could be held liable to an independent contractor’s employee, regardless if the defendant retained control over the work, if: “it knows or reasonably should know of a concealed, preexisting dangerous condition on its premises. . . the contractor does not know and could not reasonably ascertain the condition. . . and the landowner fails to warn the contractor.” (Kinsman at pg 675).
In one of California’s most recent Supreme Court cases, mesothelioma is only raised as a comparison in two lawsuits brought against the tobacco companies for the latent diseases contracted due to smoking addiction. (Grisham v. Philip Morris U.S.A., Inc., 40 Cal.4th 623 (2007). In this case there were amicus curiae (meaning friends of the court) briefs filed arguing that different injuries can manifest at different times caused by the same exposure to a toxic substance. (Grisham at pg 643). The Supreme Court opined that this issue was raised in one of its prior decisions, the Hamilton cased discussed above. However. The Hamilton decisions was centered around the issue captivating mesothelioma and asbestosis injuries formed at two separate times, and it involved a statute of limitations question. (Grisham).
At the heart of the tobacco case, the squawk focused on an earlier manifestation of economic injury and a later manifestation of a physical injury. The court held that the economic lawsuit based on smoking addiction did not start the running of the statute of limitations for the later discovered physical injury.
Like the Hamilton mesothelioma case, the court ruled that the physical injury cause of action did not begin to accrue until the disease or physical injury was discovered, or reasonably should have been discovered. (Grisham at pages 645-646).
As you can see, asbestos-related cases provocative mesothelioma are complex litigation cases that sometimes take many years to work their way through the courts. However, California’s Supreme Court has addressed major legal issues provocative mesothelioma litigation. Cancer of the cervix (cervical cancer) begins in the lining of the cervix. Cervical cancers don’t form suddenly. Normal cervical cells gradually develop pre-cancerous changes that turn into cancer. Doctors use several terms to recount these pre-cancerous changes, including cervical intraepithelial neoplasia (CIN), squamous intraepithelial lesion (SIL), and Dysplasia.
There are 2 main types of cervical cancers: squamous cell carcinoma and adenocarcinoma. Cervical cancers and cervical precancers are classified by how they look under a microscope. About 80% to 90% of cervical cancers are squamous cell carcinomas, which are composed of cells that resemble the flat, thin cells called squamous cells that cover the surface of the endocervix. Squamous cell carcinomas usually begin where the ectocervix joins the endocervix. The remaining 10% to 20% of cervical cancers are adenocarcinomas. Adenocarcinomas are becoming more common in women born in the last 20 to 30 years.
You can prevent most precancers of the cervix by avoiding exposure to HPV. HPV is a member of a family of viruses that can cause abnormal tissue growth (such as genital warts) and other changes to cells. Delaying having sexual intercourse if you are young can help you avoid HPV. Limiting your number of sexual partners and avoiding sex with people who have had many other sexual partners lower your risk of exposure to HPV. Remember that HPV does not always cause warts or other symptoms, so a person may have the virus and pass it on without knowing it. HPV can be present for years with no symptoms. It is spread through sex. HPV infection is common. About 20 million people in the U.S. are infected with HPV, and by age 50, at least 80% of women will have had an HPV infection, according to the CDC. Most women with HPV infection don’t develop cervical cancer.
According to the American Cancer Society, in the US in 2006 about 9,710 cases of invasive cervical cancer will be diagnosed and about 3,700 U.S. women will die of cervical cancer. Worldwide, cervical cancer is a leading cause of cancer deaths for women. According to the FDA there are 470,000 new cases and 233,000 deaths each year.
Here are some symptoms that may be caused by cervical cancer. Other conditions may cause these same symptoms. Be sure to consult your doctor if any of the following problems occur:
Vaginal bleeding.
Unusual vaginal discharge.
Pelvic pain.
Pain during sexual intercourse.Symptoms
of advanced cervical cancer may include:
Loss of appetite
Weight loss
Fatigue
Pelvic pain
Back pain
Leg pain
Single swollen leg
Heavy vaginal bleeding
Leaking of urine or feces from the vagina
Bone fractures
The following procedures may be used:
PAP SMEAR: A procedure to collect cells from the surface of the cervix and vagina. A section of cotton, a brush, or a small wooden stick is used to gently scrape cells from the cervix and vagina. The cells are viewed under a microscope to find out if they are abnormal. This procedure is also called a Pap test.
COLPOSCOPY: A procedure to look inside the vagina and cervix for abnormal areas. A colposcope (a thin, lighted tube) is inserted through the vagina into the cervix. Tissue samples may be taken for biopsy.
BIOPSY: If abnormal cells are found in a Pap smear, your doctor may do a biopsy. A sample of tissue is cut from the cervix and viewed under a microscope by a pathologist to check for signs of cancer. A biopsy that removes only a small amount of tissue is usually done your the doctor’s office. It may be needed to go to a hospital for a cervical cone biopsy (removal of a larger, cone-shaped sample of cervical tissue).
PELVIC EXAM: An exam of the vagina, cervix, uterus,fallopian tubes, ovaries, and rectum. The doctor or nurse inserts one or two lubricated, gloved fingers of one hand into the vagina and the other hand is placed over the lower abdomen to feel the size, shape, and position of the uterus and ovaries. A speculum is also inserted into the vagina and the doctor or nurse looks at the vagina and cervix for signs of disease. A Pap test or Pap smear of the cervix is usually done. The doctor or nurse also inserts a lubricated, gloved finger into the rectum to feel for lumps or abnormal areas.
ENDOCERVICAL CURETTAGE: A procedure to collect cells or tissue from the cervical canal using a curette (spoon-shaped instrument). Tissue samples may be taken for biopsy. This procedure is sometimes done at the same time as a colposcopy.
Types of surgery for early cervical cancer include:
LEEP (Loop Electrosurgical Excision Procedure) – uses electricity to remove abnormal tissue
CRYOTHERAPY – freezes abnormal cells
LASER THERAPY- uses light to burn abnormal tissue
The prognosis (chance of recovery) depends on the following:
The stage of the cancer (whether it affects part of the cervix, involves the whole cervix, or has spread to the lymph nodes or other places in the body).
The type of cervical cancer.
The size of the tumor.
Treatment options depend on the following:
The stage of the cancer.
The size of the tumor.
The patients desire to have children.
The patients age.
Treatment during pregnancy depends on the stage of the cancer and the stage of the pregnancy. If found early or for cancer found during the last trimester of pregnancy, treatment may be delayed until after the baby is born.
GARDASIL
Gardasil is a vaccine that targets four strains of human papillomavirus (HPV). Those strains are called HPV-6, HPV-11, HPV-16, and HPV-18.
HPV-16 and HPV-18 account for about 70% of all cervical cancers.
HPV-6 and HPV-11 account for about 90% of genital warts.
The vaccine is also favorite to help prevent vaginal and vulvar cancers, which can also be caused by HPV.
Studies have shown 100% effectiveness in protecting against infection with HPV-16 and HPV-18 strains in people who had not been previously exposed to the virus.
Tests show that the vaccine lasts at least four years. Long-term results aren’t known yet
The FDA approved Gardasil for girls and women aged 9-26. The FDA’s decision doesn’t automatically do the vaccine part of the CDC’s recommended vaccine schedule.
The drug company Merck, which makes Gardasil, is studying the vaccine in women up to age 45 and may seek to broaden the approval group based on those results.
Merck is also continuing to research use of the vaccine in boys and men, as they can also become infected with HPV, which could lead to genital warts.
Reports from clinical trials, to date, reveal Gardasil to be valid.
Gardasil is the first cervical cancer vaccine to be approved. In fact, it’s the first vaccine to protect against a risk factor for a cancer. Another cervical cancer vaccine, called Cervarix, is also in the works. It’s expected to be submitted for approval by the kill of 2006.
Please pass this information on to any females that you know. Cervical cancer is a very serious matter to all women and this subject has not had enough light shed on it. I have personally had two abnormal pap smears and had to have a colposcopy and LEEP plan done. Afterwards, I met several females who have had abnormal pap smears as well. HPV is much more common than you may believe so please, spread the word.

My sister Jackie, was first diagnosed with breast cancer in October of 2000. Upon discovering the lump she immediately made an appointment with her doctor. It was due to this self-awareness that they were able to catch it in the earlier stages. She was then referred to an Oncologist who preformed a lumpectomy and successfully “removed all of the cancer.”
Additional testing of the lymph nods confirmed that there were no additional abnormalities. Her Oncologist had her follow up the surgery with radiation therapy. Since markers indicated that the cancer was definite for estrogen she was prescribed Tamoxifen, an anti-estrogen drug. She diligently took her medication, went to her check ups and had her yearly mammagrams as recommended by the Oncologist. All seemed well up until the spring of 2005, only months away from celebrating five years of being cancer free.
Throughout the preceding year she began to have increasing difficulties breathing. It was concluded that her childhood asthma had resurfaced and inhalers were prescribed. This seemed to alleviate the quandary to a certain degree, but her condition worsened and she began to have bouts of coughing so rude as to induce vomiting. Finally, her PCP ordered a simple, routine x-ray. It was only then that the fist size mass in her left lung was discovered. She was referred to a pulmonary specialist who put her through a series of tests. The results not only confirmed that the mass was malignant, it concluded that it had metastasized from the original breast cancer. Shrinking by the size of the mass and fearing that her current Oncologist had let her down we pleaded with her to consult a different Oncologist. She resisted our pleas insisting, “I really like her a lot. She is just so nice.”
Unwilling to go on blind faith, as we had five years earlier, we began to investigate on our own. The initial research confirmed the severity of her condition. As news spread through the family, my son-in-law called to discuss her condition.
He suggested that we take her to the Cancer Center that he had started working for only a few years earlier. After my conversation with him I pushed for us to do fair that, and for two good reasons. First and foremost, research confirmed his assessment of the oncologists. The doctors at that facility are known to be some of the best in the world. The Center was very aggressive in their treatments and always had a positive belief that the cancer could be put in remission. The other more poignant reason was his concluding statement of, “If it were me or your daughter – that’s where we would go.”
We convinced Jackie to give it a try, and were extremely pleased with the doctors and the environment. It wasn’t the grave, doom and gloom place we had been expecting. Instead, we found that everyone who worked there was upbeat and positive. The kindness of the doctors and employees was only surpassed by their professionalism. We soon discovered that it was the Center’s policy to give regular CAT scans once the patient was in full remission. In shock, we wondered why Jackie had never received anything more than a mammagram from the other doctor. How considerable sooner would we have caught the cancer if she had been given even one Cat scan? While there was no way to know for sure, we were certain it would have never reached the stage IV she was now facing. Our inflame grew as we watched the stunned reaction of doctors and nurses when they were told she had not received chemotherapy with the modern breast cancer. It was apparent to us that instead of getting the optimum treatment, she had only received the minimum. We now understood that the choice of doctors and treatment was critical in this fight between life and death.
All too often we, as laymen, just accept what doctors tell us without interrogate. Yet, it is of the utmost importance that you investigate and research every possible detail. You must educate yourself on which doctors are best and how many treatment options they can offer, for they are not all created equal.
